Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Velowork AI ("Velowork AI," "Velowork," "we," "us," or "our") governing your access to and use of the Velowork App at app.velowork.ai, the Velowork browser extension, Fluency Desk, and related services (collectively, the "Services").

By creating an account, installing the extension, paying for a window, or otherwise using the Services, you agree to these Terms and our Privacy Policy at app.velowork.ai/privacy. If you do not agree, do not use the Services.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes the organization.

Velowork provides software that helps teams run short observation windows, log workflow handoffs, optionally connect third-party app metadata, and receive aggregated reports and educational guidance about automation concepts.

The Services are not employee monitoring software sold for surveillance, performance scoring, or disciplinary action. Your organization is responsible for how it communicates participation to employees and for complying with applicable employment and privacy laws.

Fluency Desk and AI-assisted features provide general how-to guidance only. They are not a substitute for professional advice, vendor support, security review, or implementation services.

Paid hands-on engagements, Focus Maps, and custom deliverables may be offered separately at velowork.ai under different agreements.

You must be at least 18 years old and able to form a binding contract to use the Services, unless your organization authorizes your participation as an employee.

You are responsible for maintaining the confidentiality of your account credentials and any personal extension token issued to you. Do not share tokens or account access with others.

You must provide accurate registration information and keep it current. We may suspend or terminate accounts that are fraudulent, abusive, or used in violation of these Terms.

Organization administrators may invite participants, schedule intelligence windows, view adoption metrics, and access aggregated reports for their organization.

Participants connect individually — each person installs the extension, accepts consent where required, and submits their own questionnaire or journal entries.

If you participate because your employer or a client invited you, your organization controls who is invited and may define internal rules for participation. Questions about employment use of the Services should be directed to your organization first.

You agree not to:

• Use the Services for unlawful, deceptive, or abusive purposes
• Attempt to access another user's account, token, or data without authorization
• Reverse engineer, scrape, or overload the Services except as permitted by law
• Upload malware or interfere with the integrity or performance of the Services
• Use the Services to collect sensitive personal data you are not authorized to process
• Misrepresent Velowork outputs as professional, legal, security, or compliance certifications
• Resell or white-label the Services without our written permission

The Services may reference, link to, or interoperate with third-party products — including Anthropic (Claude), OpenAI, Google, Slack, HubSpot, Stripe, and others.

We do not require you to use any third-party tool. Connecting Gmail, Slack, HubSpot, workflow automation tools, or other integrations is optional and at your sole discretion.

Your use of any third-party service is governed solely by that provider's terms, privacy policy, pricing, and security practices. We are not responsible for third-party services, their availability, their outputs, or how they handle your data.

If you enable an integration, you authorize us and our subprocessors to access the scopes you approve solely to provide the Services. You can revoke connections through the Services or the third party where supported.

The Velowork browser extension may record domain names of websites you visit while connected and tracking is enabled. It does not collect page content, keystrokes, or full URL paths by design.

You choose what to enter in journal entries. Do not enter customer names, contact details, health or financial data, passwords, or trade secrets unless your organization has explicitly authorized you to do so and you accept the risk.

Intelligence windows run for a limited period. Raw event data is designed to expire after the window; aggregated reports may be retained for the organization that ran the window.

You may uninstall the extension or disable tracking at any time.

AI-generated responses may be inaccurate, incomplete, outdated, or inappropriate for your situation. You must independently verify any guidance before relying on it or implementing automations.

We do not guarantee that AI outputs will work with your specific tools, accounts, data, or compliance requirements.

Do not submit confidential, sensitive, or regulated information to Fluency Desk or other AI features unless you accept the risk that it may be processed by us and our AI providers.

Some features require payment. Prices and included features are shown at checkout or in your account.

Payments are processed by Stripe or other payment processors. We do not store full payment card numbers.

Except where required by law or explicitly stated at purchase, fees are non-refundable once a window or billing period has started. Chargebacks or payment disputes may result in suspension of access.

We may change pricing for future purchases with reasonable notice where required.

We own the Services, software, branding, documentation, and aggregated non-custom content, subject to third-party rights.

You retain ownership of content you submit. You grant us a limited license to host, process, and display your content solely to operate and improve the Services, generate reports for your organization, and fulfill related Velowork delivery where applicable.

You may not copy, modify, or distribute our software or branding except as expressly permitted.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR SECURITY.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY REPORT, RECOMMENDATION, AI OUTPUT, AUTOMATION SUGGESTION, OR THIRD-PARTY INTEGRATION WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PURPOSE.

NO ORAL OR WRITTEN INFORMATION FROM US CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VELOWORK AI AND OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICES, ANY THIRD-PARTY TOOL, OR ANY CONTENT YOU OR OTHERS SUBMIT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID VELOWORK AI FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations. In those jurisdictions, our liability is limited to the greatest extent permitted by law.

You will defend, indemnify, and hold harmless Velowork AI and our affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) content you submit; (c) your violation of these Terms or applicable law; or (d) your organization's deployment of the Services to participants without appropriate notice or authorization.

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms, create risk or legal exposure for us, or where required to comply with law.

Upon termination, your right to use the Services ends. Sections that by their nature should survive — including disclaimers, limitation of liability, indemnification, and governing law — will survive.

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of New Hampshire, United States, without regard to conflict-of-law principles.

Except where prohibited by applicable law, you agree that exclusive jurisdiction and venue for disputes will lie in the state or federal courts located in New Hampshire, and you consent to personal jurisdiction there.

Before filing a claim, you agree to contact us at hello@velowork.ai and attempt to resolve the dispute informally.

We may update these Terms from time to time. We will revise the "Last updated" date when we do. Material changes may be communicated through the Services or by email where appropriate. Continued use after an update means you accept the revised Terms.
